Telehealth Informed Consent

In case of a medical emergency, call 911 or go to the nearest emergency department – do not rely on telehealth.

Telehealth involves the use of electronic communications, information technology, or other means to enable a healthcare provider and a patient at different locations to communicate and share individual patient health information for the purpose of rendering clinical care. This “Telehealth Informed Consent” informs the patient (“patient,” “you,” or “your”) concerning the (i) treatment methods, risks, and limitations of using a telehealth platform, (ii) the means by which the healthcare providers and affiliates may communicate with you, and (iii) the assignment of benefits and your financial responsibility for the services we offer.

1. Scope of Services

Telehealth services offered by Cognitive Nutrition & Wellness, LLC, Pesto Health, Inc., Cloud Health Medical Group, P.A., Cloud Health Medical Group of California, P.C., Cloud Health Medical Group of New Jersey, P.A., Cloud Health Medical Group of Kansas, P.C., Adept Labs, Inc. d/b/a Vital and its affiliate Openloop Healthcare Partners, PC and other affiliated medical groups with which we may contract to make telehealth services available on our platform (collectively, “Provider Group”), and the Provider Group’s engaged providers (our “Providers” or your “Provider”) may include a patient consultation, diagnosis, treatment recommendation, prescription, and/or a referral to in-person care, as determined clinically appropriate (the “Services”). Your Provider will be licensed in the state where you are located at the time of your consultation, or otherwise meet a professional licensure exception under applicable state law, and will establish a provider-patient relationship in accordance with the laws and rules in the applicable state.

BetterBrain Health, Inc. (“BetterBrain”) performs administrative, payment, and other activities to support the Services of Provider Group and our Providers. BetterBrain, together with the Provider Group and Providers, are collectively referred to as “Group”, “we”, “us”, “our”.

2. Nature of Telehealth

Telehealth involves the use of electronic communications (such as video conferencing, messaging, and digital tools) to deliver healthcare services and support remotely. Through the BetterBrain platform, you may receive:

  • Appointment scheduling;
  • Review and exchange of medical or wellness records;
  • Consultations, coaching or periodic assessments from the Providers and other organizations with whom we may contract; and
  • Education and wellness support via AI-powered tools (e.g., “BeBe”).

Telehealth services are not a substitute for in-person care in all cases.

While telehealth can be convenient and effective, it may differ from in-person visits in the following ways:

  • Physical examination may be limited or unavailable because your Provider is at a distant location from you.
  • Your Provider must rely solely on the information you report during the encounter to make recommendations.
  • Equipment failures may interrupt your care.
  • Your provider may decide a telehealth visit is not appropriate and recommend in-person care instead.

3. Providers and Legal Structure

BetterBrain, which refers to the platform supporting the Providers’ Services, is not itself a healthcare provider and does not practice medicine or offer medical diagnoses or treatment. Your clinical relationship is with the Provider rendering your care.

4. Consent to Use Telehealth

By signing this Consent, you voluntarily agree to participate in telehealth services through the BetterBrain platform and understand the nature of the services provided and the risks outlined. Further, you authorize the transmission of your personal, medical, and health information electronically. Your participation indicates your understanding that certain telehealth encounters may involve audio or video recordings as described in Section 6.

You may withdraw your consent at any time. Withdrawal will not affect prior care rendered.

5. Privacy and Security

You understand that steps are taken to secure the telehealth session but that there is no guarantee of security, and there are potential risks to this technology, including interruptions and disconnections of the audio/video link, unauthorized access, and other technical difficulties. You understand that in the case of a technical failure, the Provider will make reasonable efforts to re-connect with you.

6. Consent to Recording (if applicable)

Certain sessions, such as coaching or assessments, may be recorded for training, quality assurance, or compliance purposes. You will be notified before any recording occurs and asked for your explicit consent if required by state law. You may decline to be recorded.

7. Financial Responsibility

You acknowledge and agree that insurance coverage for telehealth services may vary by provider and by state. You are responsible for payment of all services not covered by insurance, including deductibles, copayments, or services not eligible for reimbursement. You may request an estimate of costs before scheduling services.

Refunds, if offered, apply only to amounts paid without insurance. They are not available for amounts paid by or reimbursed through an insurer or health plan, consistent with federal and state anti-kickback laws, including any co-pays or out-of-pocket expenses.

8. State-Specific Disclosures

Certain states require additional information, which is provided below. Additional state-specific disclosures may appear in your scheduling flow or patient dashboard based on your location.

The following consents apply to patients accessing website for the purposes of participating in a telehealth consultation as required by the states listed below:

  • Alaska: I understand that my primary care provider may obtain a copy of my records of my telehealth encounter. I have been informed that if I want to register a formal complaint about a provider, I should visit the medical board’s website, here.
  • Connecticut: I understand that my primary care provider may obtain a copy of my records of my telehealth encounter.

  • Kansas: I understand that if I have a primary care provider or other treating physician, the person providing telemedicine services must send a report to such primary care or other treating physician of the treatment and services rendered to me during the telemedicine encounter within three days of me providing consent to the person providing telemedicine services to send such report.
  • Kentucky: I have been informed that if I want to register a formal complaint about a provider, I should visit the medical board’s website, here.

  • New Hampshire: I understand that my primary care provider or treating provider may obtain a copy of my records of my telehealth encounter.
  • Ohio: I understand that my primary care provider may obtain a copy of my records of my telehealth encounter.
  • Oklahoma: I have been informed that if I want to register a formal complaint about a provider, I should visit the medical board’s website, here; or, the Oklahoma Board of Osteopathic Examiners’ website,  here.
  • Rhode Island:  I have been informed that if I want to register a formal complaint about a provider, I should visit the medical board’s website, here.
  • South Carolina: I understand that my medical records may be distributed only with my consent and in accordance with applicable laws and regulations to other treating health care practitioners.
  • Texas: I understand that with my consent my medical records may be sent to my primary care physician within 72 hours after receiving Services.

I have also been informed of the following notice:

  • Vermont:

I understand that I have the right to receive a consult with a distant-site provider and will receive one upon request immediately or within a reasonable time after the results of the initial consult. I understand that receiving telemedicine services via Found’s Platform does not preclude me from receiving real-time telemedicine or face-to-face services with the distant provider at a future date. (VT Stat. Ann. § 9361).
